Fozer Games may offer third-party products through the Services. You assume all risks and liabilities associated with the use of any such third-party products.
By using the Services, you affirm that you are at least 18 years of age (or have reached the age of majority) or that you have reviewed these Terms with your parent or guardian and he or she assents to these Terms on your behalf.
You are solely responsible for maintaining the confidentiality of your password and user name and for any activities that occur under your Account.
The Service may include an opportunity for you to earn, buy or otherwise obtain in-game currency ("Virtual Currency") and virtual, in-game digital goods ("Virtual Items"). Virtual Currency and Virtual Items are not real currency and do not have monetary value.
You agree that all sales of Virtual Currency and Virtual Items are final. No refunds will be given, except in Fozer Games’s sole and absolute discretion.
The Services may include opportunities to chat or participate in online forums. You understand that you may be exposed to Forum Content and actions from other users that are indecent, explicit, offensive, or which otherwise violates these Terms. Unless otherwise specified in these Terms, any and all title, ownership, rights, and intellectual property rights in and to the Services including all content therein (collectively the “Fozer Games Content”) shall remain in Fozer Games.
THE SERVICES ARE PROVIDED “AS IS" AND ALL CONDITIONS, REPRESENTATIONS AND WARRANTIES ARE HEREBY DISCLAIMED TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW.
FOZER GAMES WILL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND ARISING FROM YOUR USE OF THE SERVICES, INCLUDING, WITHOUT LIMITATION, DIRECT, INDIRECT, INCIDENTAL, PUNITIVE AND CONSEQUENTIAL DAMAGES.
These Terms will automatically terminate if you fail to comply with any term hereof. You and Fozer Games have the right to terminate or cancel your Account, at any time for any reason.
These Terms and any action related thereto will be governed by the laws of Georgia without regard to its conflict of laws provisions. Any dispute arising from or relating to the subject matter of this Agreement shall be finally settled by the courts located in Tbilisi, Georgia.
Any proceedings to resolve or litigate any dispute in any forum will be conducted solely on an individual basis. Neither you nor Fozer Games will seek to have any dispute heard as a class action, private attorney general action, or in any other proceeding in which either party acts or proposes to act in a representative capacity.
If the Fozer Games Software is provided to you through the Apple Inc. (Apple Inc. together with all of its affiliates, "Apple") App Store, the following terms and conditions apply to you in addition to all the other terms and conditions of this EULA:
These Terms, along with the Privacy Policy, constitute the complete and final agreement between Fozer Games and you.
